kansas AG mess

Simon, interesting development out here in the Great Plains. Paul Morrison, a Dem who successfully defeated Phill Kline for the KS Attorney Generalship, resigned today because of sexual harassment allegations arising out of a co-employee, 2-year affair at his old job as Johnson Co. prosecutor. Ironically, Kline is now the JoCo prosecutor- a position he got through an appointment after losing to Morrison in the '06 election. (Flow chart available upon request).

My question is directed to the omniscient Tully- how will the KS independent AG slot get filled now? By our Gov (a Dem)? Our legislature (GOP)? Another election? Inquiring minds want to know.

I'm neither Tully nor conversant with Kansas law, but I think the answer's in Ks. Statutes 25-312:

All vacancies in any elective state ... office, unless otherwise provided for by law, shall be filled by appointment by the governor, until the next general election after such vacancy occurs, when such vacancy shall be filled by election. When any elected office is provided by law to be filled by appointment by the governor of a person selected by a party district convention, and the immediately past incumbent of such office was an independent without political party affiliation, the vacancy shall be filled by appointment by the governor, until the next general election after such vacancy occurs, when such vacancy shall be filled by election.

Oh come on, it wouldn't be that bad. You'd probably get some

of the most long-winded opinions in the history of the Court, though.

The idea of former President Clinton as Chief Justice doesn't sound as crazy to me as it probably should, but I am sure that this one thing would cause his enemies' heads to explode. :)

Any attorney who has been

Any attorney who has been disbarred and fined by their state bar as part of a plea deal to avoid felony perjury prosecution, AND forced to resign the federal bar to avoid Supreme Court disbarment and federal felony perjury prosecution, should NEVER be considered as a SCOTUS candidate.

That seems like a very reasonable and minimal standard to me, and it definitively excludes William Jefferson Clinton in all particulars as a SCOTUS candidate. That's before one reaches his otherwise weak resume for such an appointment.

Can you imagine those confirmation hearings? They could do more damage to the Democratic party than four years of Kucinich as President.

Well, I think it's already

Well, I think it's already established that certain parts of the Democratic Party don't want lawyers on the court - recall that Clinton himself did everything he could to put a politician on the court (Cuomo, Babitt et al) before he finally buckled.

Yeah, you're not kidding. I wasn't seriously suggesting that

Clinton on the SCOTUS would be a good idea, BTW. As you said, his losing of his law license is a strike out right there, not to mention his lack of of judicial experience.

Besides, his talents would be wasted on the Court. Now, Ambassador to the UN is more up his alley, and I'm entirely serious on this one.

I don't know that UN Amb would be a good idea, but it would certainly be more appropriate for him! (That's not a compliment to either Clinton nor the UN.)

Maybe Justice Spitzer or Lieberman

I shudder more at a Biden justice and an Obama Justice. No, I can't say that speculation was filed under "chocolate". I just can't see Bill enjoying the Justice lifestyle. I would prefer Bill over Biden as SECSTATE. McCain just recieved Lieberman's endorsement. I think Joe could team with Mitt or McCain and be a problem for Dems.

You're aware that they work long hours and each get four interns law clerks every year, right?

Spitzer and Lieberman? Courts aren't patronage appointments to be divvied up; the goal of appointments to the court isn't ideological balance, it's judges who do the job legitimately. If the Democrats want to recognize that, if they want to nominate people like Hugo Black rather than Bill Brennan, I'll start getting more comfortable with the prospect of their being in a position to nominate them. But right now, it seems to me that the people running the show in the Democratic party still see the courts as a battering ram for social change, an inertia left over from the Warren Court, will make nominations accordingly, and have to be kept out of positions where they can act on that urge.

Miers vs. Clinton? That's tough. I've often said that conservative judicial activism isn't any more valid than liberal judicial activism, but I suppose that if I had to choose between the one or the other (and I'd rather not, but the rise of Huckabee increases the odds that such a choice will be presented next fall), I'd take the former.

Yes, SCOTUS should not be a patronage club. I would feel more comfortable however, with Bill rather than Miers. I agree that Dems wrongly see the court as a critical player in the political struggle to reshape the social paradigm, but they also fear the converse by ideologically-bent conservative judges Republicans rail to pick.

The NIE, SCOTUS and news media have all been politicized to a growing extent. I can't lay this blame largely on Democrats though they consider it "their turn". In fact, I would argue Biden's recent verbal romps would make him less persuasive a SECSTATE than Bill were the latter given a clear mission. The real problem would be a divergence between Hillary's and Bill's tact on a particular negogiating subject which is why special envoy would make more sense. I would like to see Hillary and Bill double team Putin, Chavez, Ahmadinejad and Hu. I wonder if Biden's support would give him either SECDEF, SCTOTUS or SECSTATE. Lately, I have a problem with all three.

I'm not sure we can trust anything any candidate says these next few weeks. Bill saying he opposed the war from the start gives Hillary a bit of slack, but makes him sound flipping. I have a good record of what Bill actually said on Iraq at the time. Everything is about politics and of course, the court has and will be a grail to fight over. There is a large segment out there that side more with those who would be more likely to pick a judge that would protect privacy, environmental law, voter's rights, hate crime, torture and capital punishment bans as well as more regulation of firearms and technology related to crime and terrorism. It is the failure to compromise in Congress that has both sides politicizing the court. Newt has made control of the court a prime mission.

I worry that were we to lose objectivity in all three branches, government might escape Contitutional constraint and labor under the cycle of partisan elections and national crisis.

I have always favored a McCain candidate. Whereas Hillary has gained by the writer's strike, McCain has lost being the Republican darling of Comedy Central crowd. Congressional disapproval ratings as well as the present freefall of Pelosi and company (Iraq, NIE, NK, Pakistan eventually playing for the Republicans) will emerge as the voting begins. Judges are one thing both sides can rally around. Al Gore will undoubtedly bring up the issue of SCOTUS deciding elections and threatening Roe. Funny if he stumps later with Hillary for what position? Justice Gore? UN? Holy Snore!

I suspect McCain or Hillary with a divided Congress will stay closer to the middle. Huckster or Obama would fair worse if either's holding much Congressional sway. With eight years in mind, however, the pick could be a base play and in that case, the Democrats have more of a legitimate worry should a Republican win, -thus the use of the issue now.

I was joking Pat, because Spitzer obviously made a deal with Clinton to retract immigration plan just before the debate. You should read the fighting between Cuomo and Spitzer. NY has some pretty strange politics. I would say that picking Miers over Clinton might be construed as tacit support for socons, though I am sure you did not mean it as such. The filling of positions in the Justice Department with graduates of that religiously connected law university, might also be seen as tacit support by those Republicans that saw no issue. I do not see Kos or Huffington given important positions in a Clinton administration. The issuse of judges is also about the courts in general and the belief that given Congressional gridlock, courts will decided the course of law rather than rule on consistency between 21 century law and the Constitution.

What did he accomplish, Max?

I just don't see much in the way of real success by Clinton in the diplomatic arena while he was President. He largely left the rest of the world alone, which, in my opinion, allowed to fester and grow many of the problems we are coping with today.

I think he also failed to find concrete ways to reduce the long-term military capabilities of Russia when we could have. We should have been paying them cash for nukes, hiring every single nuclear physicist in Russia that we could and moving them to the U.S., etc. I don't think he saw the potential for such long-term moves, or the risk that Russia would backslide as it is with Putin currently. (Bush hasn't either, btw).

And his ties to China remain very suspicious. So no, no Bill for Sec. State for me. Biden's got pretty decent views on foreign policy, particularly for a Democrat, but you are correct that in reality is foot-in-mouth syndrome makes him unsuitable for the job.
