Partially seeing the light

Submitted by Simon on Thu, 10/25/2007 - 1:51pm

Lambert at Corrente is breathlessly excited that Majority Leader Steny Hoyer "ha[s] seen the light on restoring Constitutional government," Hoyer having apparently reminded an audience that members of Congress "swear an oath to defend the Constitution of the United States...." Wonderful! Since Hoyer has seen the light and now believes that the United States must be governed within the confines of the Constitution of the United States, I eagerly await Hoyer's announcement that he will be, inter alia, removing himself as a co-sponsor of (and will repudiate) H.R. 1433, a bill that attempts to make "the District of Columbia ... a Congressional district for purposes of representation in the House of Representatives," a proposition so obviously and flagrantly in violation of the Constitution that there is no serious argument (and barely an argument of any kind) that could sustain it. After all, if Hoyer wants to champion the Constitution, he will surely agree that he can't take it when it's convenient to his policy views and leave it when it stands athwart them, a position that Prof. Wechsler rightly described as "the antithesis of law."
