No matter who gets nominated they will be savaged during confirmation hearings. Politics, after all, comes first.
I was just saying over at Volokh...
I was just saying at Volokh that I think Chertoff might be the one guy in the country who would be HARDER to confirm than Gonzales would be at this point. Now we get to relive Katrina for a few weeks, then "torture," both in the guise of Chertoff's role in same, followed by a reprise of all the problems at DOJ, in the guise of what Chertoff intends to do to fix same.

Bush needs to put in someone - Chertoff, Clement, Robert Bork, anyone competent who'll do the job - by recess appointment now. Because right now, the Senate Democratic leadership is racing to get the Senate back from recess a week early to ensure that doesn't happen. If Bush doesn't do this, we will have no AG in place for weeks while the dems draw out the hearings into a circus.

Absolutely the best plan is to stick in another Bush crony who will have no credibility with the Congress or the American people.

Clement, then a nominee, then Clement....
Politico quotes a "senior administration official" as noting that Paul Clement, now acting AG, "can stay in that position for quite a while."
The same or another "administration official" describes the law: "An individual may serve in an acting capacity for 210 days. However, if there is a pending nominee, the 210-day "clock" is reset at Day One when the nominee is announced. The clock is reset again if the nomination is withdrawn or fails."
According to BackwardsBush, there are 511 days left in the Bush Administration. Perhaps it's time for a nice game of "run out the clock." Couple of rushing plays, then take a knee.
I'm not sure if getting
I'm not sure if getting "savaged" during the confirmation hearings is necessarily a bad thing as there is certainly a debate to be had over the direction of the DoJ and the relationship b/ween the Executive and the DoJ; although how interesting the discussion will be depends on the ratio of Biden-like political grandstanding to actual issues being discussed, (ok, we'll probably see way too much of the former, but I'd still like to see these issues hashed out).
What everyone has said makes sense....
Kneel down later with a nominee that presents the most difficulties for the Democratic nominee to object. An intelligent pick might put Hillary on the spot. Powel-like might put Obama on the spot. Of course, in a sane world I would put in a person now who shows Republican moderation. Lieberman doesn't seem available nor Ashcroft. Posner would confuse the Democrats. If they stick in a Bork, that would be the worst thing really for the Republicans and I see how Democrats would love that pick, Simon. More than energize Republicans, it will drive Independents away and energize the Left despite their anger after a Democratic turn to center. Actually, Giuliani wouldn't be bad if he wasn't running. I suppose he couldn't do both, but given the time Gonzales has been investigated, Giuliani could probably run and serve....LOL.

Yes Justin? Confirmations will be campaign-led. The Republicans are in a pickle without a wise choice. Now what makes me think this will not happen? Want to bet on who Rove thinks would work?

The show must go on? Hell, a confirmation battle might sidetrack the Surge Report. How about someone who has intimate details on Reid and Company? One who worked with Reno and the Clinton administration? Sounds intersting. Wonder what next August recess will bring.

Any doubt anybody had that we might have hearing aimed at actually understanding anything should disappear with this quote. If Reid were a judge, he'd be recused from the case for having prejudged it, based just on that statement alone.

In the spirit of bipartisanship, why not Janet Reno again? She was quite good at keeping those pesky investigations away from her president. AND the democrat congress would have to approve her.

As a New Yorker, do you know about his record in court, or is it really a mythology? Who did he really put behind bars? I suppose one can't run for president AND be AG, but I think it would be a good selection for the Republicans.
