Palin’s E-Mail Account Hacked, Published on Web Site
In the latest of a series of invasions into Sarah Palin’s personal life, hackers have broken into the Republican vice presidential candidate’s private e-mail account, and a widely read Web site has published screen grabs from it.
An article Wednesday in Gawker.com posts family photos and snapshots of e-mail exchanges the Alaska governor had with colleagues. Gawker says the-email account has since been shut down, but it will leave the images up on its site for all to see.
“Here are the screenshots of the emails saved before the account went dark, along with the contact list. It’s newsworthy and we will not be taking it down!” the site declares.
The applicable federal statute is 18 USC § 2701, "Unlawful Access to Stored Communications." There may well be others*, but that one pops to mind. State statutes would likely also be involved.
They're still on Gawker as of this posting. I suggest an immediate DMCA notice and then aggressively spreading the prosecutions. And honing up the tort attorneys.
Ah, the left. We're not supposed to snoop on enemy communications in the field without a warrant from a domestic judge, but it's peachy-keen to feloniously and publicly violate the privacy of anyone you don't like.
UPDATE: Kathryn Jean Lopez notes: Maybe this hacker crime suggests McCain isn't a foolish old man for not using "the e-mail" after all. Hey, maybe the whiners are just mad he's not vulnerable.
*--UPDATE: Volokh points us at 18 USC § 1030(a)(2)(c) as the relevant statute. Well, I knew them law-talkin' folk would find more.
UPDATE: The hacker has been tentatively traced as a Tennessee college student whose father is a Democratic state representative. Given the nature of hacking and the method of tracing used, I'd want to see that firmed up with server logs going back to the IP of origin before taking it as confirmed--but it will no doubt be shouted loudly about the rightosphere, so be aware that it's a tentative trace and NOT confirmed at this point.

Every time, it seems like the media has hit the bottom with Palin. Every time, we think it's going to get better - or at least not worse.

This sort of stuff is clearly on the other side of the line between political shenanigans and criminal behavior. It's not merely indecent, it's wrong. Illegal.

I suppose one could debate the point of Gawker being "left," but only with anyone not acquainted with the site and its audience demographics. They're the favored stalkarazzi gossip blog of the more juvenile lefties I know. I've never gotten a Gawker link from anyone center or right, I get them all the time from lefties of my acquaintance. (Some of my best friends...) And if I wasn't clear, it's Gawker I'm calling low--and they are likely happy to be noticed as the little bottom-feeding scumpuppies they are, that being their raison d'?tre.
Legally Gawker may be tough to put a hit on for this, but morally they're as guilty as those they facilitate, and I hope the investigation hurts them badly, and that between that and civil suits that things get very very expensive for them.
The mail-hackers themselves are as yet unknown, though there are rumors floating. Can't assign motivation until they're positively ID'd and and such. I suspect they'll be juvenile little sh*ts whose politics (if any coherent) run along the lines of the moronic anarchists we saw parading at the GOP convention protests.

Yeah, most likely, as I don't believe anyone in the mainstream on either side is so vile (or stupid) to do something like this. The thing is though, the debate about which side is worse shouldn't even matter, as all sides ought to condemn this as the criminal and immoral behavior that it is. This is just taking it too damn far.
