Salazar's eligibility

Submitted by Simon on Mon, 12/15/2008 - 8:43pm

Obama appointee eligibility series:
Clinton I Clinton II Clinton III Clinton IV Clinton IV(a) Salazar I

Senator Salazar as Interior Secretary? Not so fast. 5 U.S.C. § 5312 doesn't distinguish between State and Interior for the purposes of salary, and neither does the January 2008 executive order raising the pay of that class of officers, so Salazar - last elected in 2004 - presumably suffers from the same disability as Hillary Clinton. We explored that issue in posts linked back from this one.

It does seem like Obama is

It does seem like Obama is trying to depopulate the Senate. Eligibility question aside, Salazar may be the best choice we can expect. Maybe he is just making these appointments in a reverse Miers: hoping the GOP challenges them so he can appoint someone further left. However, that would really require a tin-foil cap to think that.

I was thinking the same thing

Jim;
I asked myslef this morning when I heard the Salazar news "Is some sort of record? How many Senators is that?" And what does a democratic Senate majority mean when so many are new to the body. Good thing Harry Reid is such an able-bodied commander!

It's Banana Republic Time!

It's Banana Republic Time! Seriously, this is Change®?

I kind of like Salazar--at least as compared to the potential alternatives.
